it really depends on the state and the prosecution but for the most part: Murder 1- killed with intent and was premeditated. Murder 2, killed with intent but not was not premeditated (best example would be a heat of the moment killing(i.e. I walk into the bedroom and find my husband fucking the maid and I go to the closet and shoot them both dead. Their murder wasn't planned but I shot them both with intent to kill.). Manslaughter, killing was not planned and there was no intent but your actions cause the death of person (i.e. you get into a fight and you punch someone in the nose and it leads to their death. You didn't plan on killing them, didn't intent to kill, but legally your action cause that person's death.

some states skip the whole Murder 1 and 2 since both are quite interchangeable and can be very difficult to try court and just go to Murder, Capital Murder, and Manslaughter. Like my example of shooting and killing the husband and maid could easily be argued as Murder 1 because I went and grabbed a gun to shoot them. A lot of times Murder 1 cases are filed down to Murder 2 or Manslaughter because intent and premeditation can be hard to prove
