Savannah Dietrich, 17-Year-Old Sexual Assault Victim, Faces Charge For Naming Attackers

A 17-year-old Kentucky girl who was upset by the plea deal reached by a pair of teenagers who sexually assaulted her is now facing a contempt charge for tweeting their names in violation of a court order.

The Associated Press does not normally report the names of sexual assault victims, but Dietrich and her parents say they do not want to shield her identity and want her case to be public.

The boys' attorneys have asked a judge to hold Dietrich in contempt for violating the confidentiality of a juvenile hearing and the judge's order not to speak about it.

Dietrich told the paper she was assaulted in August 2011 by two boys she knew when she passed out after drinking at a gathering. She learned months later that pictures of the assault were taken and shared with others.

"For months, I cried myself to sleep. I couldn't go out in public places," she told the newspaper, as her father and attorneys sat nearby. "You just sit there and wonder, who saw (the pictures), who knows?"

Dietrich's attorneys want her contempt hearing open to the media, arguing she has a First Amendment right to speak about her case and to a public hearing.

The boys' attorneys, however, have asked to keep the hearing closed.

The contempt charge carries a possible sentence of 180 days in jail and a $500 fine.

The boys pleaded guilty on June 26 to first-degree sexual abuse and misdemeanor voyeurism. Dietrich says she was unaware of a plea agreement until just before it was announced in court.

She could not say what the proposed punishment was because of the court order, but said she feels like it was a slap on the wrist.

The teens are to be sentenced next month, and the judge could reject or modify the terms of the proposed agreement.

When Judge Dee McDonald admonished everyone at the hearing not to speak about what happened in court or about the crime, Dietrich said she cried.

"They got off very easy ... and they tell me to be quiet, just silencing me at the end," she said.

Afterwards Dietrich tweeted, "They said I can't talk about it or I'll be locked up. ....Protect rapist is more important than getting justice for the victim in Louisville."

David Marburger, an Ohio media law specialist, said Dietrich should have tried to get the courts to vacate the gag order rather than simply violating it.

But Gregg Leslie, interim executive director of the Reporters Committee for Freedom of the Press, said Dietrich should "not be legally barred from talking about what happened to her. That's a wide-ranging restraint on speech."

Leslie said this sort of issue is becoming more common.

"In the past, people would complain to anyone who would listen, but they didn't have a way to publish their comments where there would be a permanent record, like on Facebook and Twitter, for people to see worldwide," he said.

Dietrich said she just needed to stand up for herself. "I'm at the point that if I have to go to jail for my rights, I will do it."

She is such a strong person to identify herself like that. This is FUCKED UP that they get off scot-free when they were able to rape her, show photos of her body to anyone who they fucking wanted to, and not provide her with this information ... what an awful, awful thing. I'm glad she's speaking out against it, although it's bullshit.

Well, to be fair, from the post above, they didn't get away scot free. (They did plead guilty to two charges, and are awaiting sentencing.) I do agree that it's pretty freaking ridiculous to not be allowed to talk about your own sexual assault. (Esp. when there are pictures.) But it does sound as though at least *something* is being done. Probably not enough. But...

As far as I am concerned, they were charged as juveniles, and their victim is unable to discuss what happened to her with anyone, lest anyone find out what they did to her. While they will be sentenced to something, it's probably not much, and it's certainly not enough.

I guess I see the fact that she's facing more punishment for tweeting their names as them getting off completely, but you're right. I personally hope someone does some internet sleuthing and figures out who they are so the internet can take revenge.

The internet had NO PROBLEM taking down those kids who made fun of the old lady on the bus, they should have no problem attacking rapists.

Yeah. I might feel some vague sympathy for them about their identities being exposed if they hadn't posted the pictures. (Because they are minors, and we do believe "innocent until proven guilty", etc. etc. Not much sympathy, but still...I can see the rationale for saying, "Until the trial is over, no sharing names for various legal reasons.") But as soon as the pictures came out...really? I mean, these are not people who seem to have any concerns about their own privacy.

It would be nice to see the Internet take these rapists down. Will hope.

That is so gross being told you can't talk about your own assault- or at the very least have to omit who did that to her. And fuck that too when they were showing around the pictures. They clearly had not problem identifying her to shame her for what they did to her (and probably were find with their friends knowing it was them at that time too), but now that they realize this will look badly on them the want the court to bar her from naming them? Fuck that and fuck the judge for going along with that.

This is absolutely ridiculous, but I'm not surprised. After the unbearable two hours of contemplation and hysterics that followed an incident in which I was sexually assaulted, I went to my counselors who immediately called the police and my parents. My parents were two hours away so the police arrived before they could get there and I shit you not, the police officer sat me down, told me my attacker copped to it and that he was crying, and then asked me if I could just "forgive" my attacker and it could all be over. I was fucking stunned silent for a good pause before I managed to say, "I know my parents will want to press charges." The officer proceeded to sigh dramatically before pulling out his notebook and taking my statement, again PARENTS WERE NO WHERE AND HE WAS DOING ALL THIS. If I hadn't been so fucking numb and unable to think, I would have asked to wait until my parents arrived. But at that point, I wanted it to be over because I felt so utterly confused and almost guilty because I was going to ~ruin this kid's life. The experience was so bad that it made me do the unthinkable several years later when I was sexually assaulted by a drunk D-list celebrity. I told no one and did not call the police because I was terrified of losing my job at that entertainment company and I had already faced so much shit the first time when it was just a kid in the Midwest, how was I going to be treated when I was out in California and accusing afore mentioned D-list celebrity? I should have called the police. I should have said fuck you to that job. But I was still young and slightly naive. I haven't went out to singles bars in a couple a years and I would like to think I've changed somehow, but I don't know if it's possible to not revert to that meek little girl who is powerless whenever a guy gets fresh with her. I just. UGH. Fuck this entire case. Fuck society in general for being a culture that protects rapists and assault perpetrators. I don't even know if this made sense, but I just had to get it out.

I am so sorry that you had to have those experiences :( fucking disgraceful. My sister was assaulted and when she reported it to the police, they basically made her out to be a slut because she had sex the night before with someone and that was that. went absolutely nowhere. so I rage with you at these cops.

Those boys ALREADY VIOLATED THEIR OWN PRIVACY by showing pictures of Dietrich to others. It didn't seem like they were all too concerned about the implications or their connection to what happened to her until they got in trouble for it.

The justice system needs to fuck off if they feel they need to protect the privacy of these boys.

Fuck this whole BS "protect the babies" because they are minors? Uh NO. Plus I must be missing something but didn't her attorney have to agree to the plea bargain? Also shouldn't he have consulted his client before anything was done like agreeing??? So confused about what the hell happened to common sense in this.

No, of course not.. The Victim gets to have an opinion and usually speaks at sentencing, but plea bargains are between the prosecution, defense, and the judge.

This has less to do with the type of crime committed (though that is a factor) and more to do with the fact that the Defendants are juveniles. If you are going to argue the point, arguing that the courts are "protecting rapists" while true misses a key point. The court is "protecting juveniles, who happen to be rapists"

I just don't understand ... shouldn't they have been charged with child pornography for showing nude photos of her around, which would get them charged as adults?

As far as I am concerned, the victim's rights need to trump the rapist's. I find it fucked up that as a society, we're willing to dogpile on a bunch of mean 12-year-olds who will make fun of an old lady on a bus, but we're going to talk about rehabilitating a bunch of 16 and 17 year olds who will rape a girl and show photos of the rape to anyone who will lok at them.

The guys who did that gave up their right to privacy when they took away her privacy with both the assault and the fucking SHARING OF PHOTOS OF AN ASSAULT. The teens and their parents should be wondering how the fuck they got a place where they were able to do that and not wasting time concerned about their reputations. It's too late for that.

fucking seriously? someone had undergone a traumatizing event that was in no way at all her fault (and instead clearly whose), and she still gets put through more SHIT for said incident? i don't understand what goes through these people's minds to come to a conclusion that, "oh yeah. sexual assault victim, summing up the courage to actually talk about it when society has taught women to remain hush-hush because it's 'embarrassing'? oh hell naw, off to jail you go."

i was once told by an (nypd svu) police officer that when they get a call related to a teen girl's sexual assault/rape, they start with the assumption that she is lying, usually to avoid getting in trouble for skipping curfew.

incredibly gross. bc she essentially nonchalantly admitted that they treat the potential victim (usually from the projects) like a criminal until they break and "admit the truth" (sic).

i was there with my (white, cis, femme, etc) date who was trying to follow up on her own reported assault. all i could do was leave my jaw open in silence. my face is frequently easier to read than dr. seuss.

When men claim anything about a "bullshit rape charge" or the like, I automatically assume plea agreement--the court bargained with them on it so they can call it whatever they want, right? Fuck.

Good on this girl, hope this is reversed for her. We need a justice system, not a shelter-rapists-and-abuser system.
